Current to 2022-12-15 · Official PDF

(1) The Court may take cognizance of the conduct of
liquidators of companies that are being wound up by the Court, and
if a liquidator does not faithfully perform the liquidator's duties
and duly observe all the requirements imposed on the liquidator by
statute, general rules, or otherwise with respect to the performance
of the liquidator's duties, or if any complaint is made to the Court
by any creditor or contributory in regard thereto, the Court may
inquire into the matter, and take any action thereon it thinks
expedient.
(2) The Court may at any time require any liquidator of a company
that is being wound up by the Court to answer any inquiry in
relation to any winding-up in which the liquidator is engaged, and
may if it thinks fit, order that the liquidator or any other person be
questioned on oath concerning the winding-up before a clerk of the
Court named for the purpose, or any special examiner appointed by
the Court.
(3) The Court may also direct a local investigation to be made of
the books of the liquidator.
