79 Offences and Penalties Offences and penalties
(a) fails to comply with sectio n 10.1(1), 12(1), 12.2, 13(2),
14(3), (4), (5), (6), (7) or (7.1), 16(2) or 21,
(b) fails to comply with an order of the Director under section
78.2 that has not been stayed,

(c) furnishes false information or misrepresents any fact or
circumstance to an inspector or to the Director, or
(d) fails to comply with an undertaking under this Act
is guilty of an offence.
(2) Where a body corporate is convicted of an offence, the body
corporate is liable to a fine of not more than the greater of
(a) $100 000, and
(b) 3 times the amount obtaine d by the body corporate as a
result of the offence.
(3) Where an individual is convicted of an offence, the individual
is liable to a fine of not more than the greater of
(a) $25 000, and
(b) 3 times the amount obtained by the individual as a result of
the offence.
(4) Where a person is convicted of an offence in respect of section
13(2) or 14(3), (4), (5), (6) or (7), the fine provided for the offence
may be imposed for each day or part of a day on which the offence
occurred or continued.
(5) The total amount of a fine imposed on a person in respect of a
continuing offence referred to in subsection (4) may not exceed the
amount set out
(a) in subsection (2) for a body corporate, or
(b) in subsection (3) for an individual.
