79.2 Vicarious liability
employee or agent of a developer is deemed also to be an act or
omission of the developer if the act or omission occurred
(a) in the course of the em ployee's employment with the
developer, or
(b) in the course of the agent' s exercising powers or performing
duties on behalf of the developer under their agency
relationship.
