79.4 Government's costs

(1) The Director may require a person who is investigated
under this Act and who
(a) is the subject of an order of the Director under section 78.2,
or
(b) has entered into an undertaking
to pay the costs that the Government incurs in the investigation or
that arose in the process leading up to the issuance of the order of
the Director or the entering into of the undertaking.
(2) The Director must notify a person referred to in subsection (1)
of the amount of the costs, and the person has 30 days from
receiving the notice to file an objection with the Director respecting
the amount of the costs.
(3) On receiving an objection within the 30-day time period
specified in subsection (2), the Director must submit the matter to
an arbitration process approved by the Minister.
(4) A person who is required to pay costs under subsection (1) is
liable to pay
RSA 2000

(a) the amount specified in the Director's notice, if no objection
is filed within the 30-day time period specified in subsection
(2), or
(b) the amount specified in the decision of the arbitrator,
and the Director may collect the amount by civil action for debt.
