52 Disqualification of director
director if that person
(a) is not an individual;
(b) is under 18 years of age;
(c) is an individual who
(i) is a represented a dult as defined in the Adult
Guardianship and Trusteeship Act or is the subject of a
certificate of incapacity that is in effect under the Public
Trustee Act,
(ii) is a formal patient as defined in the Mental Health Act,
or
(iii) repealed 2022 c16 s3(14);
(iv) has been found to be a person of unsound mind by a
court elsewhere than in Alberta;
(d) has the status of bankrupt.
(2) A cooperative may provide in its bylaws for additional
qualifications or disqualifications.
(3) Unless Division 2 of Part 18 applies to the cooperative, a
majority of the directors must be individuals who are not full-time
officers or employees of the cooperative.
(4) At least 25% of the directors must be resident in Canada.
