64.1 Binding judicial dispute resolution proceeding

(1) The Court may, in its sole discretion, with the written
agreement of all parties, conduct a binding judicial dispute
resolution proceeding.
(2) The practice and procedure for a binding judicial dispute
resolution proceeding shall be as set out in the regulations.
(3) If the action is not settled by the parties at the binding judicial
dispute resolution proceeding, the judge may give a judgment in
the action despite the judge's participation in settlement
discussions in respect of the action.
(4) A judgment given at a binding judicial dispute resolution
proceeding is final and binding and, despite section 46, is not
subject to appeal.
