21 Execution of consent

(1) When a disposition of the homestead of a deceased married
person is made during the lifetime of the surviving spouse, the
spouse shall execute the consent in the prescribed form.
(2) The Registrar of Land Titles before registering a disposition of
land that is made by the executor or administrator of the estate of a
deceased married person, and that
(a) does not purport to be consented to under this Act by the
surviving spouse, and
(b) is not accompanied with an order of the Court dispensing
with the consent of the surviving spouse,
shall require from the executor or administrator an affidavit in the
prescribed form.
