42 Appeal by complainant to the Discipline Committee
that no further action will be taken may, within 30 days after
receipt of the notice and by notice in writing to the Registrar,
appeal that direction to the Discipline Committee.
(2) On an appeal under subsection (1), the Discipline Committee
shall determine whether the complaint
(a) is frivolous or vexatious, or
(b) should be investigated and heard by it in accordance with
this Part.
(3) The Discipline Committee shall notify the complainant and the
practitioner concerned in writing of its decision under subsection
(2).
