25 Disciplinary action
right of Alberta and a bargaining agent under the Public Service
Employee Relations Act, an employee may be dismissed, suspended
or subjected to other disciplinary action by the employee's
department head
RSA 2000
(a) if the employee is unable to satisfactorily perform the
employee's duties, or
(b) for misconduct, improper conduct or negligence.
(2) Subject to any collective agreement between the Crown in right
of Alberta and a bargaining agent under the Public Service
Employee Relations Act, if the employee is on permanent
appointment the employee may appeal against the dismissal or
other disciplinary action in the manner prescribed by the
regulations.
(3) Nothing in this section or the regulations impairs or otherwise
affects the right of the Lieutenant Governor in Council to reinstate
or dismiss any employee.
