Part 2 — Designated Office Holders Interpretation

25.1 Interpretation

(1) In this Part,
(a) "designated office holder" means a designated office holde r
referred to in section 25.2;
(b) "Ethics Commissioner" means the person appointed as
Ethics Commissioner under the Conflicts of Interest Act;

(c) "former designated office holder" means a designated offic e
holder who has ceased to hold a position referred to in
section 25.2;
(d) "provincial agency" means a Provincial agency as defined in
the Financial Administration Act, and includes a
management body within the meaning of the Alberta
Housing Act
and a provincial health agency, regional health
authority, provincial health corporation and subsidiary
health corporation under the Provincial Health Agencies
Act.
(2) For the purposes of this Part, a person is directly associated
with a designated office holder if that person is
(a) the designated office holder's spouse or adult
interdependent partner,
(b) a corporation having share capital and carrying on busines s
or activities for profit or gain of which the designated office
holder is a director or senior officer,
(c) a private corporation carry ing on business or activities for
profit or gain of which the designated office holder owns or
is the beneficial owner of shares,
( d ) a p a r t n e r s h i p
(i) of which the designated office holder is a partner, or
(ii) of which one of the partn ers is a corporation directly
associated with the designated office holder by reason of
clause (b) or (c),
o r
(e) a person or group of persons acting with the express or
implied consent of the designated office holder.
(3) In this Part, "private interest" does not include the following:
(a) an interest in a matter
(i) that is of general application,
(ii) that affects a designated office holder as one of a broad
class of the public, or
(iii) that concerns the rem uneration and benefits of a
designated office holder;

(b) an interest that is trivial;
(c) an interest of a designated office holder relating to
publicly-traded securities held in the designated office
holder's blind trust or investment arrangement approved by
the Ethics Commissioner under section 25.24.
(4) Sections 2(4) and 28(4) do not apply in respect of this Part.
