34 Offences and penalties

(1) No person shall
(a) without the Director's consen t, remove, deface or interfere
with a copy of a community safety order or any other order
posted in accordance with this Part,

SAFER COMMUNITIES AND
(b) without the Director's consent
(i) fail to vacate a proper ty that is closed under a
community safety order, or
(ii) enter or re-enter a property that is closed under a
community safety order,
o r
(c) fail to comply with a community safety order.
(2) Every person who contravenes subsection (1), section 26,
section 30(2), section 31, section 33(1) or (2), or an order of the
Director is guilty of an offence.
(3) Every person who is guilty of an offence is liable
(a) for a first offence
(i) in the case of an individual, to a fine of not more than
$10 000, to imprisonment for a term of not more than
one year, or to both;
(ii) in the case of a corporation, to a fine of not more than
$25 000;
(b) for each subsequent offence
(i) in the case of an individual, to a fine of not more than
$25 000, to imprisonment for a term of not more than
one year, or to both;
(ii) in the case of a corporation, to a fine of not more than
$100 000.
(4) If a corporation commits an offence pursuant to this Part, any
officer or director of the corporation who directed, authorized,
assented to, acquiesced in or participated in the commission of the
offence is guilty of the offence and liable to the penalties
mentioned in this section whether or not the corporation has been
prosecuted or convicted.
