146 Property owned by individuals

(1) Where
(a) property owned by an individual is located in an area wher e
a separate school district has been established, and
(b) the individual who owns the property declares that the
individual is of the same faith, whether Protestant or Roman
Catholic, as the faith of those who established the separate
school district,
the property owned by that individual is assessable for separate
school purposes.
(2) Property owned by an individual who is not referred to in
subsection (1) is assessable for public school purposes.
(3) Where
(a) property is held by 2 or more individuals as joint tenants or
tenants in common, and
(b) that property is located in an area where a separate school
district has been established,
that property must be assessed for separate or public school
purposes, in accordance with subsections (1) and (2), in proportion
to each individual's interest in the property.
(4) For the purposes of this section, when property is held by 2 or
more individuals as joint tenants, they are deemed to hold that
property in equal shares and the property must be assessed
accordingly.
