217 Notice of termination

(1) Subject to section 214(2), a notice of termination of a
contract of employment or of a designation made pursuant to
section 202, 203 or 204 must not be given by a board or a teacher
(a) in the 30 day s preceding, or

(b) during
a vacation period of 14 or more days' duration.
(2) Notwithstanding section 215(1) and subsection (1), if a teacher
or principal has been convicted of an indictable offence, a board
may terminate the teacher's or principal's contract of employment
or the designation made pursuant to section 202, 203 or 204
without prior notice
(a) on the conclusion of an appeal from the conviction or a
proceeding to quash the conviction, or
(b) if no appeal is made and no proceeding is commenced, at
the end of the period within which an appeal may be made
or a proceeding commenced.
