162 Execution or proof of execution

(1) Subject to subsection (2), on being satisfied of the due
execution of an instrument, the Registrar may authorize its
registration notwithstanding that
(a) the execution is defective, or
(b) the proof of the execu tion is absent or defective.
(2) The Registrar may refer a matter arising under subsection (1)
in respect of an instrument to the court and the court may authorize
the registration of the instrument notwithstanding that
(a) the execution is defective, or
(b) the proof of the execu tion is absent or defective.
