199 General Provisions Use of name of owner by beneficiary in action respecting land, etc.
granted or of any lease, mortgage or charge affecting that land
shall, on the application of any beneficiary or person interested in
it, allow the owner's name to be used by the beneficiary or person
in any action, suit or proceeding that it may be necessary or proper
to bring or institute in the name of the owner concerning the land,
lease, mortgage or charge, or for the protection or benefit of the
title vested in the owner, or of the interest of any such beneficiary
or person, but nevertheless the owner is in any case entitled to be
indemnified in the same manner as that in which a trustee was
entitled, prior to May 9, 1906, to be indemnified in a similar case
of the trustee's name being used in any such action, suit or
proceeding by the trustee's cestui que trust.
