Current to 2026-05-14 · Official PDF

(1) A landlord may terminate a periodic tenancy of a mobile
home site located in a mobile home park by serving a notice of
termination on the tenant at least 365 days before the day named in
the notice of termination if termination of that tenancy is sought
(a) for the purpose of obtaining vacant possession of all of the
mobile home sites located in that mobile home park in order
to use the mobile home sites otherwise than as mobile home
sites,
(b) for the purpose of obtaining vacant possession of the mobile
home site in order that the site may be sold as a
condominium unit or as part of a condominium unit if a
condominium plan that includes that site is registered or is
proposed to be registered in the land titles office, or
(c) for the purpose of obtaining vacant possession of the mobile
home site in order that the site may be sold or leased to a
cooperative under the Cooperatives Act whose primary
purpose is to provide mobile home sites for the use of its
members and their families at cost or as nearly at cost as
possible.
(2) Notwithstanding subsection (1), if the tenancy agreement is
terminated by the tenant before the day specified in the notice, the
landlord may rent the mobile home site to another tenant for the
period remaining until the day specified in the notice, if the
landlord gives that tenant notice of the termination date before
entering into the tenancy agreement.
