Prompt Payment and Construction Lien Act s. 1.1

(1) This Act or a provision of this Act may, subject to section 5
and in accordance with the regulations, apply to a prescribed class
of professionals acting in a consultative capacity.
(1.1) Except as provided in the Public Works Act, this Act does not
apply in respect of a public work as defined in the Public Works
Act.
(2) This Act does not apply in respect of
(a) repealed 2024 c20 s2,
(b) agreements to finance and undertake an improvement in
which either of the following is a party:
(i) the Crown in right of Alberta;
(ii) a provincial corpor ation as defined in the Financial
Administration Act that is an agent of the Crown in
right of Alberta,

(c) any other agreement, entity, undertaking or work or class
of agreements, entities, undertakings or works as may be
prescribed for the purposes of this section.
(3) Subject to the regulations, this Act does not apply in respect of
a prescribed person or entity, whether incorporated or not, that
enters into a prescribed project agreement to finance and undertake
an improvement or to a prescribed class of such persons, entities or
project agreements.
