Part 1 — General
5 Waiver
person that this Act does not apply or that the remedies provided by
this Act are not to be available for the person's benefit is void.
(2) A member of a prescribed class of professionals acting in a
consultative capacity may, in accordance with the regulations,
waive any right or obligation under Part 2.
(3) Any waiver under this section must be set out in a contract or
subcontract, as applicable, and must apply only to the extent that it
does not conflict with and is not inconsistent with the regulations.
(4) In the event of a conflict or inconsistency between the contract
or subcontract referred to in subsection (3) and the regulations, the
regulations prevail to the extent of the conflict or inconsistency.
