12.1 Provision of services by individuals

(1) Subject to the regulations, an individual may provide a
type of service set out in the regulations if the individual has the
qualifications or meets the requirements set out in the regulations
in respect of that type of service.
(2) Despite subsection (1), where the existence of a public health
emergency has been confirmed under section 29(2.1) or where a
state of public health emergency has been declared under section
52.1
,
(a) the Minister or Chief Medi cal Officer may by order specify
qualifications that an individual must have or requirements
that an individual must meet in order to provide a type of
service instead of or in addition to any qualifications or
requirements set out in the regulations, and
(b) an individual may provide the type of service referred to in
clause (a) if
(i) the individual has the qualifications or meets the
requirements specified in the order made under clause
(a), and
RSA 2000

(ii) the individual has the qualifications or meets the
requirements set out in the regulations that the order
made under clause (a) requires the individual to have or
meet, if any, in order to provide the service.
