139 Caveat to protect restrictive covenant
restrictive covenant running with or capable of being annexed to
land,
(a) section 138 does not apply, and
(b) where the dominant tenement is not identified in the cavea t,
section 137(1) does not apply.
(2) Subject to section 137(2), a caveat referred to in subsection (1)
may be modified or discharged only by an order of the court made
under section 48.
