97 Implied powers of lessor
subject to the Residential Tenancies Act or the Mobile Home Sites
Tenancies Act, there shall also be implied the following powers in
the lessor, unless a contrary intention appears in the lease:
(a) that the lessor may, by himself or herself or his or her
agents, enter on the demised land and view its state of
repair, and may serve on the lessee, or leave at the lessee's
last or usual place of abode, or on the demised land, a notice
in writing of any defect, requiring the lessee within a
reasonable time, to be mentioned in the notice, to repair it,
insofar as the lessee is bound to do so;
(b) that in case the rent or an y part of it is in arrear for the space
of 2 calendar months, or in case default is made in the
fulfilment of any covenant, whether expressed or implied in
the lease, on the part of the lessee, and is continued for the
space of 2 calendar months, or in case the repairs required
by the notice, as provided in clause (a), are not completed
within the time specified in the notice, the lessor may enter
on and take possession of the demised land.
