40 Possession unobtainable
home site will be available for occupation by the tenant at the
beginning of the tenancy, the tenant may
(a) repudiate the tenancy agreement or apply to the Court of
King's Bench for specific performance of the covenant,
(b) recover general damages resulting from the breach, and
(c) recover special damages resu lting from the breach if those
damages could reasonably have been foreseen by the
landlord as a consequence of the breach.
