173 Effect of pecuniary interest on agreements
of the municipality has a pecuniary interest is binding on the
municipality unless
(a) the agreement is for work in an emergency,
(b) the agreement is
(i) for the sale of goods, or
(ii) for the provision of services to the municipality or to
persons contracting with the municipality
at competitive prices by a dealer in those goods or services
that is incidental to or in the ordinary course of the business,
RSA 2000
(c) the proposed agreement is approved by council before the
agreement is signed by the municipality, or
(d) the agreement was entered into before the term of the
councillor started.
