175.1 Declaration of disqualification by council
(c), (d), (e) or (j) and does not resign immediately, a council may
declare the person to be disqualified and a position on council to be
vacant from the date of the declaration.
(2) If a person is declared to be disqualified under subsection (1),
the person may apply to a judge of the Court of King's Bench for
an order determining whether the person is qualified to be or has
ceased to be qualified to remain a councillor.
(3) An application made under subsection (2) may be made only
within 30 days of the declaration by council.
