34.1 Requirements respecting eviction
occupant from residential premises
(a) only in accordance with an or der for recovery of possession,
and
(b) unless the court orders otherwise, only after the civil
enforcement agency is satisfied that
(i) the order has been served on the tenant or overholding
tenant or, where section 33 applies, the person living in
the premises and the tenant, and
(ii) an affidavit of service has been filed in the Court of
King's Bench by the person who has the order for
recovery of possession.
