146 Order re caveat

(1) In the case of a caveat filed by the Registrar as hereinafter
provided, the applicant or owner may apply to the court as
provided for by the Alberta Rules of Court to be served on the
RSA 2000

person on whose behalf the caveat has been filed for an order that
the caveat be withdrawn or discharged.
(2) If the person on whose behalf the caveat has been filed is a
minor without a guardian or a represented adult without a trustee,
the court may by an ex parte order direct that the application be
served on the Public Trustee, or some other person to be named in
the application, and may impose on the applicant any terms as to
the costs of the guardian or other person appointed by the order that
seem just.
(3) On the application, the court may make any order in the
premises, either dismissing the application, discharging or
withdrawing the caveat, or directing any of the parties to
commence proceedings by action or otherwise that to the court
seems just and proper.
