104 Application by Public Trustee
who
(a) is subject to a permanent guardianship order under the
Child, Youth and Family Enhancement Act, or
(b) is a represented adult or an incapacitated person,
the Public Trustee is under no duty to make an application under
this Division on behalf of the family member if the Public Trustee
is satisfied that the family member is receiving adequate support.
(2) The Public Trustee may make, but is under no duty to make, an
application under this Division on behalf of a family member not
referred to in subsection (1)(a) who is under 18 years of age.
