95.1 Transitional
application referred to in section 95 is before the Court,
(a) section 95 as it read immediately before the coming into
force of this section applies, and
(b) section 95 as it reads on or after the coming into force o f
this section does not apply
in respect of the application.
(2) Despite subsection (1), the Court may, if it considers it just to
do so in all of the circumstances, order that subsection (1) does not
apply in respect of the application.
