Part 3 — Phased Development

37 Court order terminating development

Notwithstanding anything in section 36, where a building or
land is to be developed in phases and
(a) the developer, before all the phases that make up the tota l
development are registered or are otherwise completed, is
assigned into bankruptcy, is adjudged bankrupt or has a
receiver of its assets appointed, or
(b) the developer is unable or unwilling to register or
otherwise complete the project as required under this Part
or in accordance with the phased development disclosure
statement,
the developer, the corporation or an interested party may apply to
the Court for an order terminating the development and giving
directions or a determination in respect of any matter arising out of
the termination of the development.
