73.91 Notice before levying chargeback

(1) For the purpose of section 39.01 of the Act, before
levying a chargeback on an owner, a board must serve a notice of
the proposed chargeback on the owner.
(2) The notice must be served on an owner no later than 90 days
after the board becomes aware, or in the circumstances ought to
have become aware, of an act or omission referred to in section
39.01(1) of the Act.
(3) The notice must contain the following information:
(a) the name and unit number of the owner subject to the
proposed chargeback;
(b) the date of and a descrip tion of the act or omission
referred to in section 39.01(1) of the Act;
(c) the estimated amount o f the proposed chargeback;
(d) the deadline, which must not be less than 10 days,
excluding holidays, after service of the notification, for
the owner to provide a written response to the board.
(4) After a written response under subsection (3)(d) has been
served on the board or when the deadline for a written response has
expired, whichever is earliest, the board may, based on the
information available,

(a) by resolution, levy a ch argeback on the owner, or
(b) decline to levy a chargeback on the owner.
